Nintendo Patent Infringement Suit Over Wii Controllers Revived

The Federal Circuit revived a lawsuit against Nintendo that accused the video game maker of infringing a patent relating to synchronizing data streams with its Wii, Wii U, and Switch controllers.

The district court erred in its claim construction of the term “input signal,” which it used to rule for Nintendo, the U.S. Court of Appeals for the Federal Circuit found in a precedential opinion. The U.S. District Court for the Western District of Washington construed the term too narrowly and relied too much on an expert’s testimony and extrinsic evidence, the Federal Circuit ruled.
